E3 – Top 10 Real Estate Issues Fiduciaries Miss

Often there is a gap in knowledge when it comes to the sale of real property by a Fiduciary. Probate
attorneys are not Real Estate Attorneys. Real Estate Attorneys are not Probate Attorneys. Real Estate
Agents are usually not Attorneys. The repetitive use of California Association of Realtors (C.A.R.) Forms
can give the appearance that all that needs to be done to successfully sell a property is to check a series
of boxes and DocuSign. In order to thwart complaints from both beneficiaries and buyers, attention to
detail should be given to every step of the sales prices. This presentation will review the Top 10 issues
which are often missed, misinterpreted, or mishandled when Fiduciaries (as exempt sellers) sale real
property.

Logan Martinez joined FRES upon graduation from New York University, Stern School of Business.  Logan earned a Business & Political Economy (BPE) degree.  Logan brings sharp analytics when viewing the financial aspects of the real property and brings a fresh look at marketing, utilizing digital and social media to promote each listing.

During his studies, Logan lived in world financial centers, including Manhattan, London and Shanghai. The elite Stern BPE program emphasized the relation between macroeconomics and world politics.  BPE is comprised of three core components.  The Economics Core focuses on microeconomics, macroeconomics, international economics, and emerging markets.  The Politics Core focused on political theory, comparative politics, and international relations. The Social Impact Core focused on personal and professional ethics, corporate social responsibility and the role of law in business and commerce.

Logan has been a licensed Real Estate Agent since 2014. Logan lends his enthusiasm and business acumen to ensure that each property is analyzed to bring the highest and best price. Logan implements both traditional, digital and creative advertising campaigns for each property.

Ruben calls upon his experience working in Real Estate and Sales Management for large corporations including Pepsi-Co, the Los Angeles Times and Jack-In-The-Box. Ruben managed the construction of new facilities and maintained existing facilities for Fortune 500 companies throughout the Western United States. Ruben was responsible for the bidding process and related contracts overseeing hundreds of contractors and vendors. His thorough knowledge of the construction process is a resource to the Fiduciary Client when selecting and monitoring contractors to ready the property for sale. Ruben can be a valuable resource to ensure that the estate receives value and high quality workmanship from contractors. Ruben’s eye for construction assists the Fiduciary Client in disclosing and remedying physical conditions which may exist on the estate property.

As a Director of Sales and Operations for large corporations including the Los Angeles Times, Ruben dealt with business owners and corporate leaders in the City of Los Angeles, managing a large sales staff. In his career as a corporate sales leader, he learned how to be a sales professional, promoting the goals of his Clients utilizing the best resources.

Ruben is proficient in Spanish. This expands not only the potential Buyers to a property, but allows Ruben to deal directly with contractors and other vendors.

Teresa Gorman is an attorney certified as a Specialist in the area of Trusts & Estates by the State Bar of California and a licensed Real Estate Broker.  Teresa opened her boutique law practice in 2000. The Law Offices of Teresa Gorman handled highly contested Trust & Estate matters with an emphasis on representation of the professional fiduciary client. Teresa was regularly appointed by the Courts to serve as court-appointed attorney and guardian ad litem to protect the rights of elder persons entangled in legal matters. 

In 2018 Teresa joined the team at Fiduciary Real Estate Services (FRES) as a Senior Broker. In her role at FRES, Teresa is part of a team representing Fiduciary clients in the sale of Estate real property assets. Teresa scrutinizes each sale to protect the Fiduciary in the sales process, ensuring  highest sales price is achieved and the Fiduciary seller has met the standard of care for their particular fiduciary role.

Teresa is an Adjunct Professor at University of California – Riverside. She taught courses in the Professional Fiduciary courses for individual seeking to meet the educational requirements to obtain or maintain a Private Professional Fiduciary license. Teresa also serves a Temporary Judge for Orange County Superior Court for Trust & Estate matters.  Teresa regularly is a presenter to various professional organizations, including local Trust & Estate Bar organizations, on variety of subjects.
