E3 – Top 10 Real Estate Issues Fiduciaries Miss

Often there is a gap in knowledge when it comes to the sale of real property by a Fiduciary. Probate
attorneys are not Real Estate Attorneys. Real Estate Attorneys are not Probate Attorneys. Real Estate
Agents are usually not Attorneys. The repetitive use of California Association of Realtors (C.A.R.) Forms
can give the appearance that all that needs to be done to successfully sell a property is to check a series
of boxes and DocuSign. In order to thwart complaints from both beneficiaries and buyers, attention to
detail should be given to every step of the sales prices. This presentation will review the Top 10 issues
which are often missed, misinterpreted, or mishandled when Fiduciaries (as exempt sellers) sale real
property.

Teresa was the founding attorney of a boutique law firm representing Private Professional Fiduciaries for almost 20 years. Teresa’s law practice included extensive trial work in the area of Trust & Estate litigation, trust administration, conservatorships, estate planning and probates. Teresa represented Private Professional Fiduciaries in complicated cases. Teresa was regularly appointed by the Court to serve as court-appointed counsel and Guardian ad Litem.

In 2018 Teresa sold her law practice and joined Fiduciary Real Estate Services. Teresa brings an experienced legal eye to the real estate transaction protecting the fiduciary client from potential claims from buyers, tenants and beneficiaries in Trust & Estate real property transactions.
