It is not uncommon for a private professional fiduciary handling an estate or trust administration to discover that the estate or trust home is occupied when the property should be vacant. As an estate or trust representative, the fiduciary does not have any information or indication as to how the occupants garnered possession of the property, whether the decedent or settlor allowed the occupant to stay; or whether the occupant is a renter. This session will navigate fundamentals of California eviction procedures; help identify nuanced fact patterns critical to determine whether local or state tenant protection laws apply; and general issues which may expose a representative to liability.
