Fundamentals of Special Needs Trust Administration, Session 1:
Nationally recognized SNT experts Peter Wall (Director, True Link Financial) and Steve Dale, JD, LLM (ED, Golden State Pooled Trust) will provide an overview of the essentials to Special Needs Trust (SNT) administration. In this first of two sessions, the speakers will review the history, current specifics and pending future changes to California and federal public benefits (Social Security, Medi-Cal, waiver programs, etc.). Additionally, Mr. Wall and Mr. Dale will cover the subtle differences between first and third party SNTs (as well as Pooled Special Needs Trusts) and how these differences may affect their administration (including an overview of the ABLE Act). The basic legal elements of SNT trust vehicles will be analyzed, along with case studies, best practice tips and case law.
Fundamentals of Special Needs Administration, Session 2:
Continuing their SNT Fundamentals session, nationally recognized SNT experts Peter Wall (Director, True Link Financial) and Steve Dale, JD, LLM (ED, Golden State Pooled Trust) will review discretionary distribution provisions and distribution vehicles for prudent SNT administration. Prudent investments, taxation, delegation of powers, funding mechanisms, and setting beneficiary expectations will also be covered. Case studies, best practice tips and case law will also be provided.
NOTE: this was a Steve Dale idea, so it still needs some fleshing out. Steve and I are doing this for UT Law in February, and he’s done it annually with great success. We would be including other SNT professionals, but obviously need PFC acceptance before approaching folks like Herb Thomas, etc. The concept is a pre-conference intensive just for fiduciaries who need a SNT refresher or want to start administering SNTs. Sessions would cover how to read an SNT, basics of public benefits, how not to get in trouble with SSA or Medical, how to do a distribution plan, etc. This will be multiple sessions, etc. – and a great way to get fiduciaries comfortable with SNTs.
